Please carefully read and understand the following terms and conditions as these will regulate and govern your transaction/s with CRATE2PLATE and any use of our site or service will constitute your acceptance of the Terms and Conditions (“agreement”) set forth herein.
TERMS AND CONDITIONS:
- Legal Requirement
- You can only use this site if you are eighteen (18) and above. By using this site, you confirm that you are at least eighteen (18) years of age and completely able to consent to and understand the conditions laid out herein.
- If you are under eighteen (18), you must be supervised by a parent or guardian when ordering and using this site.
- Trading Area
- As of the moment, our trading area is only accessible in Metro Manila. This means that our delivery option is also only available in Metro Manila. However, we have a pick-up option available for those outside of our trading area.
- Pick-up option is available at an address located at New Manila, Quezon City. The actual address will be given once payment is made.
- For those availing of the pickup option, you may also book your own courier and inform us thereafter.
- Specific Policies When Availing of Pickup Option
- You must pickup your order on the designated day of pickup made in our checkout page (“designated day”), whether personally or thru a courier. Pickups may be made from 11:00 am to 5:00pm only. Failure to pick up on the designated day will result in forfeiture of your rights under section 9 “Customer remedy for damaged and spoilt products.” However, if you fail to pickup on your designated day, you may still pick your order up on the succeeding days, just contact us.
- You agree and understand that remedies mentioned under Section 9 “Customer remedy for damaged or spoilt products” will only be applicable if you are able to pickup your order on the designated day. This is due to the fact that the quality of fresh products may quickly deteriorate.
- You agree and understand that the quality of our fresh products and those with short shelf lives (e.g. Fruits Collection, Vegetable Collection, Promo Collection if items within the collection are Fresh Fruits and Vegetables, Refrigerated Cheese/ Cream-Based Spreads or Yogurt) may have already deteriorated once you fail to pickup your orders on your designated day. You agree that we will not be liable to give you a new set of products since it was your fault for failing to immediately get your orders. What you will receive will be the products that have already been set aside for you on the designated day.
- We do not offer refunds for products not pick-upped. Refunds will only be entertained for damaged or spoilt products subject to section 3b.
- Even though you may still pickup your orders after your designated day, we reserve the right not to release previously fresh products and those with short shelf lives that are, in our opinion, either nearly or already rotten, nearly or already spoilt, or already not fit for human consumption. We will inform you immediately once the said products have been disposed.
- For order of products with long shelf lives such as, but not limited to, frozen products and canned goods (e.g. Rose’s Kitchen Nut Butters, items under snacking corner collections), you may still pickup these orders within two (2) days from your designated day (in case you fail to pick them up on your designated day). After two (2) days from your designated day, we will be charging a storage fee of fifty (50) pesos per day until you pickup your order. However, once these products are near expiration or are already expired, we reserve the right not to release these products to you anymore.
- You must immediately notify us of any changes or cancellations of your orders. We will try our best to accommodate your requests. The cutoff time for change or cancellation of order is at least three (3) hours before 11:00am of your designated day. However, we reserve the right to decline any change or cancellation of order even if requested on time for any reason. Also your designated day will not change even if your request for change of order is accepted. You must still pickup your order on your designated day unless we give you a different day of pickup for your changed order.
- You are allowed to request for a change in order or cancellation only one (1) time per transaction.
- You agree and understand that, while we have given a distinction between products with short and long shelf lives, ultimately, the products’ categorization will be subject to our reasonable discretion.
- All other provisions found in this agreement are applicable to the Pick-up option as long as those provisions are not contrary to any provisions found in this section.
- Ordering and order confirmation
- You agree that the acceptance of any order/s made in this site are subject to the complete discretion of Crate2plate. We reserve the right to decline or cancel any transaction, even those already confirmed, without the need to substantiate it.
- Order cutoff time for same day delivery is at 12:00 pm for Mondays and 1:30pm for Tuesdays to Saturdays. We reserve the right to stop processing same day deliveries even before the cutoff time has ended.
- It is your responsibility to enter the correct name, delivery address, email address, and contact number to avoid any delivery delays that incorrect entries may cause.
- Order is confirmed once you have received an order confirmation email.
- All products are subject to availability. You will be notified on the day of delivery if your order is unavailable and you can opt to receive store credit or refund for the value of the unavailable item.
- Prices and payments
- Prices of the products offered are found on the site. However, these are still subject to final verification even when the order has been paid or confirmed. We reserve the right to void any orders for products that have been inadvertently priced.
- We reserve the right to change the price of any product at any time without further notice.
- For the protection of everyone involved, we reserve the right to seek further verification from you in case we suspect any fraudulent activities from your mode of payment.
- Payment methods made available to you are as follows: a) Credit/ Debit Cards, 2) Gcash, 3) Paymaya, 4) Bank Transfers. You understand and consent to our use of third-party providers that process and store your information for your cashless payment.
- You warrant that you are legally allowed to use the cashless payment mode you have availed of.
- Shipping and other fees
- Shipping fees are made available once you proceed to our checkout/payment page.
- Free shipping can also be availed for orders above a certain amount. This amount can be found at our home page as this may vary from time to time.
- Additional fees will be charged if we have already engaged the services of a courier and they are unable to deliver to you due to your own fault or negligence. You will be charged a “no show” fee of two (2) times the value of the shipping fee charge if this happens. On top of the “no show” fee, you will again be charged for the applicable shipping fees in case we decide to proceed with the transaction and re-deliver it again the following day. Please note that if you have availed of the free delivery, you will still be charged the “no show” fee and it will be based on the applicable shipping fees based on your delivery location. Please note that this section will also apply if you order for a third party/ another person and that person fails to receive your order.
- We reserve the right to change the shipping fees without any further notice.
- Delivery
- Delivery is available only to addresses located in Metro Manila.
- Changes in delivery date or delivery address must be made at least twelve (12) hours before date of delivery. You are only allowed to request for a change of the delivery date or delivery address one (1) time per transaction.
- Available delivery dates are shown upon checkout.
- No deliveries are made on Sundays.
- If delivery has been made and no one is there to receive the order, you will be charged the applicable fees found under section 6 “Shipping and other fees”. If you fail to receive our delivery, we have the option of delivering your order again the next day or we may cancel your order and you will be given a refund but you will be liable for the applicable fees, if any, for its processing. Please note that this section will also apply if you order for a third party/ another person and that person fails to receive your order.
- As we use third-party couriers, you agree and understand that that we do not control the time and means of delivery. You further agree and understand that our delivery is subject to the availability of these third-party couriers, therefore , even though we will exert all reasonable effort to make our deliveries on-time, we cannot guarantee deliveries. In the event that we cannot make the delivery on the specified delivery date, we will inform you immediately and you will have the option to either cancel the order (no cancellation fee if this happens) or wait until we are able to process the delivery.
- We reserve the right to suspend deliveries if we deem that it is not safe due to any reason including, but not limited to, inclement weather conditions and you consent to this. Deliveries will resume immediately once it is deemed safe to resume operations.
- Order changes and cancellations
- You must immediately notify us of any changes or cancellations of your orders. We will try our best to accommodate your requests.
- The cutoff time for change or cancellation of order is at least four (4) hours before the daily cutoff. Please refer to the section 4 “Ordering and order confirmation” for the daily cutoff times. We reserve the right to decline any change or cancellation of order even if requested on time for any reason such as, but not limited to, the fact that the order may already be on route or the delivery has already been processed.
- You are allowed to request for a change in order or cancellation only one (1) time per transaction.
- As promos are available for limited times only, any order changes may result in the unavailability of the promo you have previously availed of.
- We reserve the right to cancel any orders without any reason.
- Customer remedy for damaged or spoilt products
- If you receive products that are damaged or spoilt, you should notify us within twenty-four (24) hours from receipt of the product. Please already include pictures and/or videos of the product in your complaint. We will immediately investigate but we reserve the right to require from you further proof or substantiation of the allegedly damaged or spoilt products. Once your claims are found to be valid, we will immediately process your refund.
- If your complaint is made past the twenty-four (24) hour window, it will be purely our discretion if we will still accept or carry-out an investigation of your complaint.
- You accept and understand that the twenty-four (24) hour window is a reasonable period to properly file a complaint due to the nature and kind of products that we sell.
- Refunds
- If you are entitled to a refund, we will do our best to immediately process it but we cannot guarantee an exact period for you to receive the refund for any mode of payment but especially if you use a Credit/ Debit Card as payment. Processing times for refunds to Credit/ Debit Cards may vary.
- Refunds will be processed back to the account used in the original transaction and could be subjected to different processing requirements. You understand and agree to comply with these requirements, if any, before you can receive your refund.
- Applicable charges or fees for the refund shall be shouldered entirely by you unless it is due to Crate2plate’s fault that you need to receive a refund.
- Service Refusal
- While we endeavor to cater to all your purchases, there are extenuating circumstances wherein we cannot accommodate them despite payment or order confirmation, therefore we reserve the right to refuse or cancel any orders without giving any reason.
- Refund or store credit will be given in lieu of the payments already made in the event that we cannot cater to your purchase.
- Store Credit
- Store credit do not expire.
- Store credit are not transferrable.
- Promos/loyalty rewards
- As we value your continued patronage, promos are made available from time to time but are subject to the availability of the products found in the promo.
- We reserve the right to discontinue any promos or loyalty rewards without any prior notice.
- Data Privacy Application/Policy
- Any and all personal information given to Crate2plate are subject to our privacy policy and protection of personal data as can be found herein (PRIVACY POLICY) ( please put the privacy policy in another link).
- Accuracy of Information
- While Crate2plate makes all reasonable effort to provide accurate descriptions of its Products, we do not and cannot warrant that the information such as, but not limited to, description, color, and price found in the site are completely accurate, consistent with the actual products, or without any error. Furthermore, the weight, measurements, and other descriptions that have been listed are only approximate figures and may not accurately represent the actual products.
- We remind you that the site may contain errors or inaccuracies such as, but not limited to typographical errors. We reserve the right to change, at any time and without any prior notice, any errors throughout the entire ordering process and even after the order has been confirmed. Furthermore, we reserve the right to void or decline any orders of products with pricing or availability errors even if the order has already been confirmed.
- We also cannot guarantee that your computer, tablet, or mobile’s monitor and program will display any color or feature of our products and the site itself accurately.
- Circumstances beyond our control
- You understand that we cannot be made liable for our failure to perform our obligations if caused by unforeseen circumstances or events beyond our reasonable control, such as, but not limited to, inclement weather conditions. During these situations, we reserve the right to suspend our service until such time as we deem it safe to resume our operations.
- Applicable laws on Force Majeure shall also apply.
- Jurisdiction
- You acknowledge that content and information published in this site are intended for users located only in the Philippines. We do not make any representation that anything found herein are appropriate or available outside of the Philippines.
- Governing Law
- You agree that that any dispute, claim, or controversy arising from the use of this site shall be brought to the appropriate Courts of Quezon City, Philippines only, to the exclusion of all other courts.
- Limitation of liability
- You agree and understand that Crate2plate or any party involved in the creation and management of the site shall not be liable for any damages such as, but not limited to, direct indirect, incidental, consequential, punitive, and/or injury arising from your access, use, inability to use, errors, content, information and any application found in this site.
- You further agree and understand that you expressly waive any and all claims against Crate2plate, its directors, officers, employees, consultants, agents, and affiliates that may arise from your use, inability to use or access to this site.
- Disclaimer
- The contents found in this site may contain errors of various kinds as such we reserve the right to make changes at anytime without prior notice. We remind you that the contents and materials in the site are distributed “as is, where is” and are without any warranties of any kind whether expressed or implied, to the fullest extent allowed by applicable law. I.E. We do not warrant merchantability or fitness for a particular purpose. We do not warrant that any content found in the site are error free, that the errors will be corrected or that the site is free from harmful content like viruses. We do not warrant the accuracy, completeness and quality of any content on the site. However, the mentioned exclusions may not apply if applicable law do not allow for the said exclusions.
- Intellectual Property Rights
- All intellectual property rights of all content, whether images, text, logos, or applications on this site are the property of Crate2plate and may not be used, in any form or manner, without the express written consent of Crate2plate. Our site may also contain content owned by third-party that are the intellectual property of their respective owners.
- Indemnity
- You agree to indemnify, defend, and hold harmless Crate2plate, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs including but not limited to, legal fees, arising from your access or use of this Site or your breach of this agreement.
- Severability
- In case any part of this agreement is unlawful, void, or unenforceable, that part is deemed severable and will not affect the validity and enforceability of the other provisions.
- Non-Waiver
- The failure of Crate2plate to immediately exercise any right under this agreement shall not be considered as a waiver thereof.
- Reservations
- We reserve the right to make any changes to this agreement at any time without prior notice.
- Termination
- We may, purely based on our own discretion, terminate or suspend your access to any and all parts of our site due to any reason, including but not limited to, any breach of these agreement.
